1. Bespoke Commissions (Customized Goods)

Under both SA Law (CPA Section 20) and EU Law (Article 16 of Directive 2011/83/EU), goods that are made to a consumer's specifications or are clearly personalized are exempt from the right of withdrawal (the "cooling-off" period).

No Change-of-Mind Returns: Once a custom commission (e.g., a painted miniature or custom build) is ordered and work has commenced, it cannot be returned for a refund based on a change of mind.

Cancellation (The Kill Fee): A 50% non-refundable deposit is required to secure your slot. If you cancel after work has started, this deposit is forfeited to cover labor and material costs already incurred.

2. Digital Products (STL Files & Tokens)

Final Sale: Digital content provided via a download link is considered "fully performed" the moment the download is initiated.

EU Right of Withdrawal: By purchasing our digital products, you expressly consent to immediate performance and acknowledge that you waive your 14-day right of withdrawal once the download starts.

SA ECT Act: In accordance with the Electronic Communications and Transactions Act, no cooling-off period applies to digital goods that by their nature cannot be returned.

3. Ready-Made Physical Goods (Retail Items)

For non-custom, physical items (e.g., unpainted "off-the-shelf" miniatures):

Return Window: We offer a 30-day return policy (standard) which exceeds the EU's mandatory 14-day cooling-off period.

Condition: Items must be in their original, unopened packaging, unused, and in the same condition as received.

Shipping Costs: For "change of mind" returns, the customer is responsible for the direct cost of return shipping to our Randburg studio.

4. Damages, Defects & "The 24-Hour Rule"

Inspection: Please inspect your order immediately upon arrival.

Damage in Transit: If an item is damaged, you must contact us at modo@strikeforcestudio.com within 24 hours with photographic evidence of the packaging and the product. This is a strict requirement for us to process insurance claims with our couriers.

Statutory Warranty (SA): Under Section 56 of the CPA, if a product is found to be genuinely defective (not through user handling) within 6 months, you have the right to a Repair, Replacement, or Refund. For custom art, Strike Force Studio reserves the primary right to professionally repair the item to its commissioned standard.

5. How to Initiate a Return

To start a return or report damage:

1. Email modo@strikeforcestudio.com with your Zoho Invoice number.

2. Provide photos if the item is damaged or defective.

3. Once approved, we will provide instructions for shipping the item back to our physical address in Randburg.

6. Refunds

We will notify you once we’ve received and inspected your return.

If approved, you’ll be automatically refunded on your original payment method (Paystack/Card) within 10–14 business days.

7. Governing Law & Final Agreement

Acceptance of Terms: By completing a purchase, commission deposit, or transaction with Strike Force Studio, you expressly agree to the terms and conditions outlined in this policy.

Legal Fallback: For any unforeseen circumstances, disputes, or matters not explicitly addressed within this document, the laws of the Republic of South Africa shall apply and take precedence. Any disputes will be subject to the exclusive jurisdiction of the South African courts.
